Kelly Testolin, JD, MBA,
Mr. Testolin is a skilled healthcare lawyer with over 40 years in the industry who has practiced in California and Nevada. His practice has been limited to the representation of health care providers in health law matters since he began practicing law.
In private practice until 2007, Mr. Testolin was consistently listed in The Best Lawyers in America and Marquis’ Who’s Who in American Law, and was been selected as one of the “Best Lawyers in America” for healthcare matters by Corporate Counsel magazine. Mr. Testolin returned to private practice in 2014.
Mr. Testolin received the Clark County Medical Society President’s Award in 2003 “in recognition and appreciation of his commitment to health law education programs benefiting Southern Nevada physicians” and the Washoe County Medical Society’s Special Recognition Award in 2004 for his “dedication and devotion to the medical profession.” Mr. Testolin lectures widely and has written numerous articles on legal issues affecting health care providers (See Exhibit A.) He is the editor and author of the Nevada Hospital Association Consent and Medical Information Privacy Manual and the Nevada Hospital Association Guide to Federal and State Anti-Dumping Laws. He served as an Adjunct Professor of Medical Jurisprudence at Touro University College of Osteopathic Medicine in Las Vegas.
Mr. Testolin has wide ranging experience in the representation of hospitals, physicians and other medical providers. He is also skilled in the representation of long term care providers, combining knowledge of applicable law and regulation with experience representing long term care facilities. He has substantial experience in representing physicians and nurses before state and federal agencies and licensing boards. He has worked extensively in all aspects of medical information privacy, including HIPAA. He has advised clients with respect to Medicare/Medicaid fraud and false claims and the “Stark” and “anti-kickback” laws, including the operation of compliance programs. Mr. Testolin’s expertise includes all facets of PPACA, ACO’s, medical homes, managed care and managed care organizations, antitrust, healthcare joint ventures, contracts, and corporate law and organization. He has completed $1,000,000,000 in corporate financing transactions and has planned and supervised many mergers, acquisitions, and consolidations of hospitals, medical groups and other healthcare providers.
Mr. Testolin holds a Master in Business Administration from the University of Chicago, Graduate Program in Hospital Administration, and a Juris Doctorate from Loyola University School of Law. He is a member of the Nevada and California bars, and a member of the American Health Lawyers Association.
