Speaker: Kelly Testolin, Attorney at Law Mr. Testolin is a skilled healthcare lawyer with over 40 years in the industry who practices in California and Nevada. His practice has been limited to the representation of health care providers and others in the healthcare industry in health law matters since he began practicing law. Mr. Testolin lectures widely and has written numerous articles on legal issues affecting health care providers. He is the editor and author of the Nevada Hospital Association Consent and Medical Information Privacy Manual and the Nevada Hospital Association Guide to Federal and State Anti-Dumping Laws.

Summary: MGMA’s Health Law Update 2018 summarizes important legal developments for health law providers that occurred in 2016, 2017 and early 2018. In the area of Fraud and Abuse, Mr. Testolin will cover the following subjects: the shift in motivation at the federal level to view enforcement as a revenue source and the resulting trends in recoveries; new fines and fining authorities that have been introduced; the use by prosecutors of multiple legal theories to get around “safe harbor” protections; the shift in federal and state focus on individuals instead of entities; new case law developments, both helpful and harmful to providers; and the emerging use of new remedies, including revocation, denied re-enrollment and “payment suspensions.” He will also provide an update on private “qui tam” litigation under False Claims Act, private payor “tag along” actions, and recent compliance guidance. With respect to Health Information Privacy, Mr. Testolin will cover the recent trend towards criminal enforcement, and dealing with hackers and “ransomware”. New Quality of Care studies have cast light on indicators of quality not previously examined and will be presented by Mr. Testolin as precursors of forthcoming enforcement activities. Last, Mr. Testolin will examine new developments and expected trends in the laws governing assisted suicide and the types of patient expectations providers will encounter.
